Policy clarifications and outstanding issues for right to work checks
03 August 2021The current Home Office guidance for employers on carrying out right to work checks contains some important clarifications of the Home Office’s policy. These will not affect the vast majority of checks. They will however be relevant in certain circumstances, especially for checks relating to EEA nationals and family members of EEA nationals from 1 July 2021. Employers should also now prepare to return to fully compliant right to work checks from 1 September 2021.

23 June 2021On 18 June 2021 the Home Office released new guidance for employers on carrying out right to work checks. This has been published ahead of significant changes to right to work checks affecting EEA/Swiss (EEA) nationals and their family members from 1 July 2021.

Home Office extends adjusted right to work checks to 31 August 2021
18 June 2021The Home Office has confirmed to the Immigration Law Practitioners’ Association that adjusted right to work checks will remain in place until at least 31 August 2021. The development comes at the eleventh hour, as full right to work checks were set to resume from 21 June 2021.

26 May 2021The Home Office has changed its policy on the use of UK residence cards (also called EEA biometric residence cards or BRCs) after 30 June 2021. Home Office announces end to COVID-19 adjusted right to work checks
21 April 2021The Home Office confirmed on 20 April 2021 that the COVID-19 adjusted right to work check process will only remain in place until 16 May 2021. Although employers will need to undertake fully compliant right to work checks from 17 May 2021, they will not have to carry out retrospective checks where the adjusted process has been used.
