Brands will often come across other organisations that are using or intending to use marks that might conflict with their rights. In many cases, brands wish to avoid protracted registry and legal proceedings and consider entering into a co-existence agreement that disposes of the present issue and looks to set out how each party will use their marks in the future.
We will discuss some of the key considerations for agreeing co-existence agreements and consider some of the legal and practical issues arising out of them, such as:
