If you are on the receiving end of an adverse ASA adjudication, concerned over the outcome of an Ofcom consultation, or threatened with a fine by the Phone-paid Services Authority, and want to know what you can do about it, then this session is for you.
We will analyse the duties and responsibilities of media industry regulators in arriving at their decisions and explore how best to challenge those decisions, considering both their internal review mechanisms and possible grounds for a legal complaint, along with likely remedies and tactics.
The session will be presented by Ben Rayment and Giles Crown. Ben is a barrister at Monckton Chambers. He is a former Legal Secretary to the UK Competition Appeal Tribunal. Ben has experience of a wide variety of heavy and complex disputes and advisory work in the CAT, Chancery Division, Commercial Court, Administrative Court as well as guiding clients through ASA, CMA and other regulatory investigations. Giles is a partner at Lewis Silkin specialising in advertising & marketing work, with many years’ practical experience of dealing with the ASA and other regulators.
