Acas has published guidance for employers on the use of non-disclosure agreements (NDAs).
The new Acas guidance follows the publication
of best practice guidance from the Equality and Human Rights Commission and the re-publication of
the Solicitors Regulatory Authority’s warning notice on the use of NDAs.
Whereas much of Acas’s guidance on using NDAs repeats that from other sources, in some cases it goes further. It remains to be seen whether employers will adopt some of its more far-reaching recommendations.
To help employers keep track of the increasing amount of guidance on this topic, we’ve created a table to clarify current legal and regulatory requirements, best practice and future proposals for using NDAs in both settlement agreements and employment contracts. We have updated this to include the latest Acas guidance.
