Now that employers are beginning to re-open workplaces (or indeed entering into more permanent arrangements around remote working), it’s worth considering the ways in which they can best protect their businesses.

The decision of the High Court in Ryanair v Bellew (published at the beginning of this year) received a very high degree of media attention, but from a legal standpoint, it has also served to highlight how little reported case law there is on Post-Termination Restrictions (‘PTR’s) in Ireland.

Ireland is host to a huge number of multi-national employers, who are always seeking to protect their businesses from damage as a result of the departure of key employees, or to manage any risk when they are recruiting employees from competitors. The protection of confidential information, the operation of notice periods and garden leave and PTR’s are all key considerations in this area.
