Brexit: from a slow drip to a full-on leak

The document – the exact publication date of which we do not know – provides a screenshot of government policy towards EU nationals and their non-EU family members. The document talks about how those individuals will be affected at three separate stages: (1) those in the UK ‘before exit’, (2) those who come to the UK during the ‘implementation phase’, and (3) those who arrive ‘after the implementation period’.

BA’s sky-high fine for GDPR breach

The CJEU’s decision in Schrems II: Privacy Shield invalidated (and SCCs in jeopardy)
17 July 2020The Court of Justice of the European Union has ruled that the EU-US Privacy Shield is invalid and that, while model clauses remain a valid mechanism for cross-border data transfers, this validity is subject to an equivalent level of protection being provided in the recipient country as that afforded by EU law.

Disclosure in English litigation: a sea change is coming
09 January 2018English rules on disclosure (‘discovery’ in many jurisdictions) are set for a major overhaul. Draft rules were published in November 2017. Once approved by the Civil Procedure Rules Committee, the resulting draft is intended to be introduced as part of a pilot scheme lasting 2 years, potentially beginning in April 2018 and running in the Business and Property Courts. This will cover virtually all High Court litigation. It will not be optional.
