I act for a variety of organisations involved in care homes, retirement housing and Extracare including housing associations, charities, private care providers, and registered providers. The development and operation of care homes and independent living schemes with support, has become a complex challenge. It often involves a mix of property skills with a knowledge of the regulatory requirements and funding of secondary healthcare and social care.

I negotiate contracts for the commissioning of social care with local authorities and health commissioners both independently and as part of the development of a new care home or housing scheme with domiciliary care. I advise on the duties and powers of local authorities and health authorities to commission social care, direct payments, personalisation and support/care agreements with vulnerable service users

Recent projects I have worked on include a commission by major legal publisher Lexis Nexis Butterworths to write specialised legal precedents and commentary for its volume on retirement housing for use by legal practitioners nationwide; and negotiating contracts secondary health services for drug and alcohol users

 Real Estate

I have over 25 years experience of dealing with Real Estate issues from the purchasing and disposal of domestic and commercial properties to the setting up of joint ventures for the development of land. In that time I have acted on numerous property transactions (freehold and leasehold) for a wide range of clients including commercial landlords and tenants, private individuals, occupiers, registered providers, and local authorities. As well as dealing with a myriad of property transactions I have advised on residential tenancies, planning issues, easements, boundary problems, defects in title and restrictive covenants.

Recent projects I have been involved in include the acquisition of a portfolio of tenanted properties, the creation of affordable housing shared ownership leases for a local authority, the creation of a ‘green lease’ for a mixed use sustainable development, advice on the unfair contract terms regulations in relation to leases for retirement housing, enfranchisement and the installation of photo voltaic cells on tenanted properties.

 Real Estate Development

Broadly my development practice covers the development of new affordable housing, retirement housing, care homes and mixed use schemes often facilitated by local authorities and other public sector bodies. 

The traditional development side of my work ranges from the acquisition of land for new build projects including  the negotiation of ancillary planning agreements  through to the negotiation of complex development agreements and the setting up of special purpose vehicles to deliver joint ventures  involving a number of parties. 

On the retirement housing side as well as acquiring sites I create specialist leases for the disposal of retirement housing; advise on service charge issues and vat efficient development structures.

Recent projects include; setting up a joint venture vehicle for the redevelopment of land to provide a mixed use and mixed tenure scheme; the acquisition of land forming part of a local authority owned estate for the development of 163 new houses, a community facility and retail space and the purchase of an office block for redevelopment involving right to light issues.

 Housing & Regeneration

I have been advising the social housing sector for more than 25 years. Mainly working on new social housing developments, but I have also advised housing associations and registered providers on  the terms and conditions of tenancies, shared ownership leases,  fixed and variable service charges, management agreements, the transfer of tenanted stock, right to buy and right to acquire, nominations agreements, and section 106 agreements.

I advise on the grant funding requirements of the Homes and Communities Agency, regulatory issues including consents to disposals under section 172 and as a number of my clients are charities vires issues. I deal with supported housing as well as general needs and I have negotiated numerous supporting people contracts as well as block and spot contracts with commissioning local authorities.

Although I have over 25 years experience of dealing with Real Estate issues for a whole range of clients private and commercial, the main focus of my practice has been on real estate for housing associations, registered providers, charities and local authorities. Even working with this specialist sector my general experience has been invaluable.

My work ranges from buying and selling sites for new build to the setting up of joint ventures for the development of land and finding solutions for charitable registered providers to fund the development of their charitable housing. As well as dealing with a myriad of property transactions I advise on residential tenancies, planning issues, easements, boundary problems, defects in title and restrictive covenants.
