Brands & Intellectual property
I advise on all aspects of brand management, including the creation and protection of brands, the exploitation of brands and brand protection and enforcement. This also entails advising on intellectual property infringement (copyright, trade marks, designs and passing off), breach of confidence and issues concerning defamation and privacy matters.
I deal with regulatory compliance with the BCAP and CAP advertising codes and with the Consumer Protection Regulations on misleading and unfair practices and the Business Protection Regulations on comparative advertising. I have a good deal of experience in handling ASA complaints and on advising on process and strategy. I have advised clients who have been involved in the ASA’s independent review process and also in applications for judicial review of an ASA adjudication.
Retail, Hospitality & Leisure
I advise all industry sectors (with a particular emphasis on the retail sector) on their branding and intellectual property issues and also on their advertising and sales promotions across all media. I also regularly advise on formulating or defending competitor complaints. Having experience of working in-house at one of the country’s top retailers, I always try to provide alternative creative approaches and solutions for clients to consider.
