I provide data protection, privacy, technology and commercial advice predominantly for clients in the retail, marketing and publishing sectors, assisting clients with mitigating compliance risks and managing the potential reputational and financial risks.

I am a qualified BCS Data Protection Practitioner and also hold the CIPP/E certification.

My practice has a focus on advising clients, particularly in the retail and marcomms sectors, on the regulatory and compliance requirements of the use of data in the provision of their services and consumer products including direct marketing, website e-commerce issues, customer relationship management and cloud computing.

Data & Privacy

I advise clients on data protection and privacy issues both as stand-alone issues and when these issues arise in the contract of other contractual arrangements with a particular interest in the use of data in the retail and marcomms sectors. I am a qualified BCS Data Protection Practitioner and also hold the CIPP/E certification.

My practice covers all areas of data privacy advice including:

  • data audits and privacy impact assessments
  • advising on the content of and drafting data protection and cookies policies
  • responding to data subject access requests
  • advising on cross-border data transfers
  • strategic advice on data compliance mechanics

Brands and Intellectual Property

I assist my clients by drafting, negotiating and advising on their business contracts, providing advice on practical issues such as limitation and exclusions of liability, termination of contracts and ownership of intellectual property and on regulatory issues such as commercial agents regulations and consumer protection laws. My experience covers the full variety of contracts from confidentiality agreements to intellectual property assignments to international services contracts dealing with complex deliverables.

I provide advice on the creation, acquisition and exploitation of digital content and technology within the retail and marcomms industries and have also spent time on secondment at one of the largest marketing communications networks, providing practical day-to-day advice to all the UK agencies within the network.

Retail, Hospitality & Leisure

I have a particular interest in the regulatory and compliance requirements of the use of data in the provision of services and consumer products in the retail sector including website e-commerce issues, customer relationship management and cloud computing. Recent experience in this area includes advising:

  • a global delivery company on obtaining consumer marketing consents
  • a national cinema chain on its customer facing privacy policy and the use of data in a marketing context
  • an advertising agency on the data protection implications of an advertising campaign for its global fast food chain client
  • a technology company providing e-solutions for retailers on data privacy compliance
  • a global retailer on its customer facing privacy arrangements and its privacy policy

Advertising & Marketing

My practice in this sector typically includes advising advertising, public relations, experiential marketing and market research agencies on their key contracts including client agreements, freelancer and key supplier agreements as well as on data privacy regulatory requirements.

I have significant experience on advising on privacy issues arising from the use of data in the provision of advertising services and my practice includes advising on behavioural advertising and ad blocking as well as the use of marketing data arising from promotions.

I provide advice on the creation, acquisition and exploitation of digital content and technology within the marcomms industries and draft a variety of documents including intellectual property licences, terms and conditions for promotions and data protection, privacy and cookies policies.

I have spent time on secondment at one of the largest marketing communications networks, providing practical day-to-day advice to all the UK agencies within the network on the full variety of legal and business issues arising.

Technology

I draft, negotiate and advise on the creation and exploitation of web-based technology, e-commerce and m-commerce solutions.

My practice includes advising on website hosting and software development agreements, cloud computing arrangements, software licensing and distribution, terms and conditions for websites, general terms of e-commerce, data hosting and processing and outsourcing. I also provide practical advice on the regulatory issues, such as data protection compliance, relating to my clients’ online, digital and social media platforms.
